Forte Athletics – Privacy Policy

At Forte Athletics L.L.C. ("Forte Athletics," "we," "us," or "our"), protecting your privacy is a top priority. This Privacy Policy explains how we collect, use, store, and safeguard your information when you use our website (www.forteathletics.net) and the Forte Athletics Pro application (collectively, the "Services").

 

By using our Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.

 

  1. Information We Collect

 

We collect only the information necessary to deliver and support our training programs. The specific data we collect depends on how you interact with us:

 

Website (www.forteathletics.net – hosted by Wix):

 

  • Name, email address, phone number, and ensemble information submitted through contact or quote request forms

  • Email addresses submitted through newsletter sign-up forms

  • Cookies and browsing data collected automatically by Wix (see Section 8 below)

 

Forte Athletics Pro Application (hosted on Amazon Web Services):

 

  • Name and email address (used as login credentials)

  • Password (encrypted; Forte Athletics cannot view your password in plain text)

  • Program participation and progress data (e.g., exercises completed, session activity)

  • Basic device information (device type, operating system) collected solely for crash reporting and troubleshooting

 

We do not collect location data, biometric data, financial information, social media profiles, or any data from the user's device beyond what is listed above.

 

1. How We Use Your Information

 

We use collected information for the following purposes only:

 

  • To deliver and administer training programs

  • To track student participation and progress within a program

  • To measure aggregate participation levels and improve the quality of our programs

  • To respond to inquiries and provide quotes for services

  • To send newsletters and updates (website sign-ups only)

  • To diagnose and fix technical issues using device and crash data

  • To comply with legal obligations

 

We do not use student data for advertising, marketing, profiling, or any purpose unrelated to delivering the training program.

2. Data Sharing

 

Forte Athletics does not sell, rent, or share personal information with third parties for their marketing or commercial purposes.

 

The following infrastructure providers support the operation of our Services:

 

  • Wix: Hosts our marketing website (www.forteathletics.net). Wix may collect browsing data and cookies through the website. Wix does not have access to data stored in the Forte Athletics Pro application. Please refer to Wix's Privacy Policy for details on their data practices.

 

  • Amazon Web Services (AWS): Provides the server infrastructure and cloud hosting for the Forte Athletics Pro application. All application data — including user credentials, participation data, and device information — is stored on an isolated AWS server. AWS acts as an infrastructure provider and does not access or use this data independently.

 

  • Third-party payment processors: Process transactions when schools or individuals purchase programs. Forte Athletics does not store full payment information on our servers.

 

We do not share personally identifiable student information with any other third parties except as required by law or as authorized by the applicable educational institution.

 

3. FERPA Compliance

 

When Forte Athletics receives personally identifiable student information from or on behalf of an educational institution, we act as a "school official" with a legitimate educational interest under the Family Educational Rights and Privacy Act (FERPA).

 

Our FERPA commitments:

 

  • We use student data solely for the authorized educational purposes for which it was provided.

  • We do not disclose personally identifiable student information to third parties except as permitted by FERPA or as directed by the educational institution.

  • We maintain reasonable administrative, technical, and physical safeguards to protect student education records.

  • We will cooperate with educational institutions to respond to parent or eligible student requests to inspect, review, or amend education records.

  • Upon termination of a school's program season or contract, student data is deleted within 30 days (see Section 6).

  1. COPPA Compliance

 

Forte Athletics does not permit users under the age of 13 to create accounts or use the Services. We do not knowingly collect personal information from children under 13.

 

School representatives (such as band directors, athletic directors, or coaches) are responsible for ensuring that no individual under the age of 13 is invited to use the platform.

 

If we discover that a user under 13 has created an account, we will immediately deactivate the account and delete all associated personal information. If you are a parent or guardian and believe we have inadvertently collected your child's personal information, please contact us at info@forteathletics.net and we will delete it promptly.

 

4. Data Retention and Deletion

 

Program data: Participation and progress data is deleted within 30 days of the end of each program season. This applies to all users, including schools that plan to renew for a subsequent season. When a school renews, a fresh data set begins with the new season.

 

Account data: Login credentials (name and email) are retained only for the duration of active program participation. Once the season ends and program data is deleted, account data is also removed within the same 30-day window.

 

Website data: Newsletter and contact form submissions are retained until you request deletion or unsubscribe.

 

Deletion requests: You may request deletion of your data at any time by emailing info@forteathletics.net. We will process deletion requests within five (5) business days.

 

Exceptions: We may retain certain data beyond these periods if required by law or to comply with regulatory standards related to student records under FERPA.

 

5. Data Security

 

The Forte Athletics Pro application is hosted on an isolated Amazon Web Services (AWS) server that is not shared with any other applications. Security measures include:

 

  • All passwords are encrypted and cannot be viewed in plain text by Forte Athletics staff.

  • The application server is isolated from other systems and applications.

  • AWS provides enterprise-grade physical, network, and infrastructure security.

  • We apply reasonable administrative, technical, and physical safeguards to protect all data, including student education records.

 

The marketing website (www.forteathletics.net) is hosted on Wix, which provides its own security measures including secure storage and encryption protocols. For details, refer to Wix's security documentation.

 

6. Cookies and Tracking

 

Our marketing website (www.forteathletics.net) uses cookies and tracking technologies provided by Wix to improve your browsing experience. For details, refer to Wix's cookie policy.

 

The Forte Athletics Pro application does not use advertising cookies, tracking pixels, or third-party analytics tools. Device information collected by the app is used solely for crash reporting and technical troubleshooting.

 

7. Breach Notification

 

In the event of a data breach that affects personally identifiable information or student data, Forte Athletics will:

 

  • Notify affected educational institutions within 72 hours of discovering the breach.

  • Notify affected individual users within 72 hours of discovery, or as required by applicable state law.

  • Provide a description of the nature of the breach, the types of data affected, and the steps being taken to address and mitigate the incident.

8. Your Rights

 

You have the right to:

 

  • Request access to the personal data we hold about you

  • Request correction of inaccurate data

  • Request deletion of your data (see Section 6)

  • Opt out of receiving newsletters by clicking the unsubscribe link in any email or by replying STOP to any SMS message

 

Parents and guardians of students may exercise these rights on behalf of their children by contacting the school or by reaching out to us directly at info@forteathletics.net.

 

9. International Data Transfers

 

All data collected through the Forte Athletics Pro application is processed and stored in the United States on Amazon Web Services infrastructure. Data submitted through the marketing website is processed by Wix, which may store data in data centers located in the United States or other regions. 10. State Student Privacy Laws

 

Forte Athletics operates nationwide and is committed to operating in a manner consistent with applicable state student data privacy laws, including the California Student Online Personal Information Protection Act (SOPIPA), California AB 1584 (Privacy of Pupil Records), and similar statutes in other states.

In alignment with these laws, Forte Athletics:

  • Does not use student data for targeted advertising

  • Does not sell or rent student personal information to third parties

  • Does not build profiles on students for non-educational commercial purposes

  • Implements reasonable security measures to protect student data (see Section 7)

  • Deletes student data at the end of each program season or upon school request (see Section 6)

 

Forte Athletics will work with schools and districts to execute contracts or addenda that incorporate provisions required by applicable state law, including AB 1584's requirements regarding data ownership, access, security, and breach notification. 11. Updates to This Policy

 

We may update this Privacy Policy from time to time. When we make material changes, we will post the updated version on this page with a revised effective date. For school and institutional customers with active agreements, we will provide at least 30 days' advance notice via email before material changes take effect.
