Forte Athletics – Terms of Service

Welcome to Forte Athletics. These Terms of Service ("Terms") govern your access to and use of the Forte Athletics website (www.forteathletics.net), the Forte Athletics Pro mobile application, training programs, online courses, and any communications you receive from us, including SMS messages (collectively, the "Services"). By accessing or using our Services, you agree to these Terms. If you do not agree, do not use our Services.

For school and institutional customers, use of the Services may also be governed by a separate Data Processing Agreement ("DPA") or institutional agreement. In the event of a conflict between these Terms and a signed DPA or institutional agreement, the DPA or institutional agreement controls.

 

1. Eligibility and Account Registration

You must be at least 13 years old to create an account or use the Services. Forte Athletics does not knowingly allow users under the age of 13 to register or participate in any program. If we become aware that a user under 13 has created an account, we will promptly deactivate the account and delete all associated data.

For school-based programs, a school representative (such as a band director, athletic director, or coach) purchases the program on behalf of the school. Forte Athletics then creates the group within the app and provides an invite code. Students 13 and older may self-register using the invite code provided by their school representative. Students under 18 must have authorization from a parent, guardian, or authorized school representative to participate.

2. Electronic Waiver and Parental Consent

Before participating in any training program through the Forte Athletics Pro application, all users are required to complete an electronic Waiver and Release of Liability within the app. No user may begin training until the waiver has been signed.

The waiver covers assumption of risk associated with physical training activities, a release of liability, a medical clearance affirmation, and an acknowledgment of the age requirement (minimum age 13). Electronic signatures are legally binding and have the same effect as handwritten signatures.

For participants under 18 years of age, the waiver must be reviewed and signed by a parent or legal guardian. A minor may not proceed without parental or guardian consent. By signing on behalf of a minor, the parent or guardian agrees to the terms of the waiver, including the assumption of risk and release of liability, on the minor's behalf.

The full text of the waiver is presented to each user within the Forte Athletics Pro application at the time of signing.

3. School and Institutional Use

When a school, district, or booster organization purchases access to the Services on behalf of students, the school or purchasing organization is the contracting party. Forte Athletics acknowledges its obligations under the Family Educational Rights and Privacy Act (FERPA) and will act as a "school official" with a legitimate educational interest when handling student data provided by or on behalf of an educational institution.

For institutional customers, Forte Athletics is willing to execute a Data Processing Agreement upon request. Please contact info@forteathletics.net to initiate this process.

4. Quotes, Purchases, and Payments

When you request a quote or purchase a program, you agree to provide accurate and complete information. Pricing may vary based on group size, program selection, and seasonal promotions. Payments are processed through trusted third-party payment processors. Forte Athletics does not store your full payment information on our servers.

For individual consumer purchases, all sales are final unless otherwise stated in the program description or unless a written guarantee is explicitly provided. For school and institutional purchases made through a purchase order or formal procurement process, cancellation and refund terms are governed by the applicable institutional agreement or purchase order terms.

5. SMS Messaging and Communication

By submitting a quote form, creating an account, or providing your phone number, you consent to receive text messages related to quotes, program details, reminders, updates, and support. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP. For support, reply HELP or email info@forteathletics.net.

6. User Responsibilities

You agree not to:
- Misuse, copy, or redistribute proprietary training content
- Reverse engineer or attempt to access restricted portions of the platform
- Share login credentials with others
- Harass instructors, directors, staff, or other participants
- Upload harmful, illegal, or unauthorized content

You are responsible for ensuring you are physically capable of participating in any training program. Consult a physician before beginning any exercise program.

7. Intellectual Property

All content provided by Forte Athletics — including videos, PDFs, guides, training programs, branding, graphics, and written materials — is owned by Forte Athletics and protected by copyright and trademark laws. You may not copy, share, or distribute any proprietary content without prior written permission from Forte Athletics.

8. Health and Safety Disclaimer

Forte Athletics provides performance training and educational content. We do not provide medical, diagnostic, or licensed healthcare services. All training is performed at your own risk.

Always warm up properly, use proper technique, modify exercises as needed, and stop immediately if you experience pain, dizziness, or discomfort. Forte Athletics is not liable for injuries, accidents, or damages resulting from voluntary participation in any program. For school-based programs, liability is subject to the terms of any applicable institutional agreement.

Forte Athletics maintains general liability insurance coverage.

9. Data Privacy and Security

Forte Athletics is committed to protecting the privacy of all users, including students. Our data practices are described in detail in our Privacy Policy, available at www.forteathletics.net/privacy.

Key commitments include:
- Student data is used solely to deliver and improve the training program.
- Student data is never sold, used for advertising, or shared with third parties for marketing purposes.
- Student data is deleted within 30 days of the end of the program season.
- In the event of a data breach, affected schools and users will be notified within 72 hours of discovery.

10. FERPA and COPPA Compliance

FERPA: When Forte Athletics receives student data from or on behalf of an educational institution, we handle that data as a "school official" under FERPA with a legitimate educational interest. We will not disclose personally identifiable student information to third parties except as permitted by law, and we maintain appropriate administrative, technical, and physical safeguards to protect student records.

COPPA: Forte Athletics does not permit users under the age of 13 to create accounts or use the Services. If we discover that a user under 13 has registered, we will immediately deactivate their account and delete all associated personal information. School representatives are responsible for ensuring that no individual under 13 is invited to use the platform.

11. Accessibility

Forte Athletics is committed to providing services that are accessible to all users, including individuals with disabilities. Our platform is designed with accessibility in mind, and we strive to align with Section 508 and Web Content Accessibility Guidelines (WCAG). Our full Accessibility Statement is available upon request. If a student or educator experiences difficulty accessing any content, please contact info@forteathletics.net and we will work with the school or district to provide reasonable accommodations.

12. Technology Requirements

Access to the Services may require a compatible device, reliable internet connection, and an updated operating system or browser. Forte Athletics is not responsible for technical issues arising from user devices, connectivity, or third-party platforms.

13. Third-Party Services

Our marketing website (www.forteathletics.net) is hosted by Wix. The Forte Athletics Pro application is hosted separately on Amazon Web Services (AWS). These are the primary infrastructure providers that support the Services.

The Services may also include integrations with third-party payment processors for transaction handling. Forte Athletics is not responsible for the policies or performance of third-party service providers. For details on how these providers handle data, please refer to their respective privacy policies.

14. Limitation of Liability

To the maximum extent permitted by law, Forte Athletics shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, program results, business interruptions, technical failures, or data loss.

For school and institutional customers, liability is subject to the terms of any applicable institutional agreement or DPA.

Your use of the Services is at your own risk.

15. Modifications to Terms and Services

Forte Athletics may update, modify, or discontinue parts of the Services at any time. We may also update these Terms periodically. When we make material changes, we will post the updated version on this page with a revised date and, for school and institutional customers with active agreements, provide at least 30 days' advance notice via email before material changes take effect.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the appropriate courts located in California, unless otherwise required by applicable law or a separate institutional agreement.

17. State Student Privacy Laws

Forte Athletics operates nationwide and is committed to operating in a manner consistent with applicable state student data privacy laws, including the California Student Online Personal Information Protection Act (SOPIPA), California AB 1584, and similar statutes in other states. Forte Athletics does not use student data for advertising, does not sell or rent student data, and does not build profiles on students for non-educational purposes. Forte Athletics will work with schools and districts to meet their specific compliance requirements, including executing contracts or addenda that incorporate provisions required by applicable state law.
